Terms and Conditions of Use

Hereinafter, "Kluppy", "we" or "the Platform".


2. Purpose and Acceptance

These Terms and Conditions (hereinafter, "Terms") govern access to and use of the Kluppy educational platform, accessible at https://kluppy.com.

By registering or using Kluppy, you accept these Terms in full. If you disagree with any of them, you must not use the platform.


3. Service Description

Kluppy is an educational technology platform (EdTech) specialising in typing learning and improvement. The service includes:

4.4. Trial period (B2B Demo)

Educational centres may request a free trial period of 30 calendar days. The trial includes:

At the end of the trial period, access is automatically limited to the free plan for all users of the centre if no paid plan is contracted. Trial period data (student progress, statistics) is retained.

4.5. Seat-based licensing and reassignment period

The Educational Centre Plan operates on a seat-based licensing model. Each licence allows one student to access the platform.

4.5.1. Licence assignment

Once payment is made, the licences purchased are added to the organisation's available pool. The centre administrator decides which students the licences are assigned to, by:

Each student joining the organisation consumes one licence from the pool. When all licences are in use, no new students can be added until existing licences are released or additional licences are purchased.

4.5.2. Reassignment period (90-day cooldown)

To ensure fair use of the service and prevent abusive licence rotation, a reassignment period of 90 calendar days applies (hereinafter, the "cooldown period").

When an administrator withdraws a student's licence (whether because the student leaves, changes class, is expelled or for any other reason):

  1. The student immediately loses access to centre features. They may continue using Kluppy in free mode with their personal account.
  2. The licence is locked for 90 calendar days from the date of release. During this period, the licence is not available for reassignment to another student.
  3. After 90 days, the licence automatically returns to the organisation's available pool and may be assigned to a new student.

We reserve the right to permanently ban or cancel your account without prior notice and without any refund right if you breach these Terms (especially regarding the use of bots, ranking manipulation, or account sharing), without prejudice to any legal action that may apply.

6.4. User-Generated Content (UGC) Moderation

We reserve the right to immediately review, hide or remove any username, profile picture, message (in tickets or chats) or interactive content that is deemed offensive, harassing, fraudulent, hateful or contrary to the law, without the need for prior notification or structured justification to the offender.


7. Intellectual Property

7.1. Kluppy Content

All elements of the platform (design, code, exercise texts, graphics, logos, icons, structure) are the property of Kluppy or its licensors and are protected by intellectual and industrial property legislation.

All rights reserved. The reproduction, distribution, public communication or transformation of any platform content without the express written authorisation of the owner is expressly prohibited.

7.2. AI-Generated Texts

Exercise texts generated by Artificial Intelligence (Vertex AI) are created specifically for typing practice. Their use is limited to the educational context within the platform.

Fair Use Policy: Kluppy reserves the right to limit or temporarily suspend a user's ability to algorithmically generate texts via Artificial Intelligence if a disproportionate, massive, or abusive use is detected that poses a serious structural risk to server stability or generates exponentially anomalous costs for the service.

7.3. Limitation of metric use and AI Act (Regulation EU 2024/1689)

Kluppy provides performance statistics (words per minute, accuracy, XP, levels, achievements) as informational tools to track typing progress and for educational gamification purposes. These metrics:

In compliance with the Artificial Intelligence Act (AI Act), the use of Kluppy is classified as a "limited risk" system as it is merely auxiliary. The use of platform metrics for official evaluation purposes is expressly prohibited, as it would constitute a breach of these terms and would shift the responsibility for regulatory compliance as a "high risk" system (Annex III of the AI Act) to the infringing educational centre.

7.4. User Content

The data you generate (statistics, progress, achievements) belongs to you and you can download it at any time from your profile ("Download my data" button).


8. Payments and Billing

8.1. Payment Processing

Payments are processed through Stripe, a PCI-DSS Level 1 certified payment gateway. Kluppy never stores your credit/debit card details.

8.2. Pricing

Prices are displayed in euros (EUR) and include VAT where applicable. We reserve the right to modify prices with 60 days' prior notice.

8.3. Billing

Invoices are issued automatically and are available in your user dashboard and by email in PDF format. To request invoices with additional tax details (Tax ID, address), please contact us.

8.4. Refunds

8.5. Right of withdrawal

In accordance with Spanish Royal Legislative Decree 1/2007 and Directive 2011/83/EU, you have the right to withdraw from the contract within 14 calendar days from the date of contracting the service, without giving any reason.

How to exercise it:

Deadline: 14 calendar days from the initial contract date. For auto-renewing subscriptions, the deadline applies only to the initial contract, not to each renewal.

Refund: The refund will be issued within a maximum of 14 days from the request, using the same payment method used in the original transaction. The refund is issued in full unless, when contracting, you expressly requested the immediate start of the service, in which case the proportional part of the service already provided up to your notice is deducted (Art. 108.3 RLD 1/2007; see the B2C Subscription Terms, section 7.2).

Exception (Art. 103.a RLD 1/2007): If the service has been fully provided with your prior express consent and with your acknowledgement that you will lose the right of withdrawal once the service is complete, the right of withdrawal shall not apply.

8.6. Non-payment

In the event of non-payment, we reserve the right to limit access to paid features until payment is regularised.

8.7. B2B licences: billing and reassignment

Educational Centre Plan licences are billed annually. The centre may purchase additional licences at any time during the subscription period; these are billed on a pro-rata basis up to the renewal date.

Licence reassignment is subject to the 90-day cooldown period described in Section 4.5.2. The centre can check the status of its licences (in use, available and in cooldown) from the administration panel, in the "Billing" section.

8.8. Renewal, upgrade and downgrade of B2B licences

8.8.1. Annual renewal

B2B licences are valid for 12 months from the date of purchase. Renewal is not automatic: the centre must make a new purchase before the expiry date.

Kluppy sends renewal reminders to the centre administrator at the following intervals:

8.8.2. Upgrade

The centre may purchase additional licences at any time during the active subscription period. New licences are added to the existing pool and share the same expiry date.

8.8.3. Downgrade

It is not possible to reduce the number of contracted licences during the active period, nor to request a partial refund. If the centre needs fewer licences for the next school year, it simply needs to purchase a smaller pack at renewal.

8.8.4. Expiry without renewal

If the centre does not renew before the expiry date:

10. Limitation of Liability

Kluppy is provided "as is". We do not guarantee that:

To the maximum extent permitted by law, our total liability to you for any claim arising from the use of Kluppy shall be limited to the total amount paid by you in the 12 months preceding the event giving rise to the claim.

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.


12. Processing of Minors' Data (Educational Centres)

When an educational centre contracts Kluppy for use with students under 14 years of age:

  1. The centre declares that it has obtained informed consent from parents/legal guardians for minors' use of the platform.
  2. The centre undertakes to inform parents/guardians about the data processing carried out by the platform, providing them with a copy of the Privacy Policy upon request.
  3. Kluppy acts as a data processor for student data, in accordance with Art. 28 of the GDPR.
  4. Student data is processed exclusively for the provision of the contracted educational service.

13. Communications

By registering, you agree to receive transactional communications necessary for the operation of the service (account confirmations, invitations, security notifications).

We will not send commercial communications without your prior consent. You can unsubscribe from optional communications at any time.


14. Termination

You may stop using Kluppy at any time. To delete your account and all your data, use the "Delete my account" button in Profile → Privacy.

15. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of Donostia - San Sebastián, expressly waiving any other jurisdiction that may apply.

For users who qualify as consumers, the courts of the consumer's domicile shall have jurisdiction.

Online dispute resolution: The European Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025, when Regulation (EU) 524/2013 was repealed by Regulation (EU) 2024/3228. If you are a consumer, you can send your complaint to info@kluppy.com or turn to the competent consumer bodies, such as Kontsumobide – the Basque Consumer Institute, or the consumer office of your region.


16. Modifications to these Terms

We reserve the right to modify these Terms. Substantial changes will be communicated with at least 60 days' notice through a notice on the platform and/or by email.

Continued use of Kluppy after notification of changes implies acceptance of the new Terms.


17. Severability

If any provision of these Terms is declared null or ineffective, the remaining provisions shall maintain their full validity and effect.


18. Entire Agreement

These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and Kluppy regarding the use of the platform, superseding any prior agreement.

These Terms and Conditions are governed by Spanish law, in particular Law 34/2002 on information society services and electronic commerce (LSSI-CE), the General Consumer Protection Law, and the General Data Protection Regulation (EU) 2016/679.
