2. Purpose and Acceptance
These Terms and Conditions (hereinafter, "Terms") govern access to and use of the Kluppy educational platform, accessible at https://kluppy.com.
By registering or using Kluppy, you accept these Terms in full. If you disagree with any of them, you must not use the platform.
3. Service Description
Kluppy is an educational technology platform (EdTech) specialising in typing learning and improvement. The service includes:
- Typing exercises adapted by level and progression
- AI-generated texts for variety and personalisation
- Progress tracking (speed, accuracy, level, XP)
- Gamification (achievements, leagues, rankings, duels)
- Management panel for educational centres and administrators
- Support system via tickets
4. Service Plans
4.1. Free Plan
Basic access to typing exercises with limited features. No cost or commitment.
4.2. PRO Plan (B2C)
Full access to all features for individual users and families. Includes:
- All levels and content
- Advanced statistics
- Family Manager (family profile management)
- Priority support
Pricing and payment terms are detailed on the pricing page.
4.3. Educational Centre Plan (B2B)
Institutional access for educational centres. Includes:
- Student and teacher administration panel
- Group and label management
- Classroom statistics
- Dedicated support
The licensing options available to centres are:
- Individual Licence: One licence per student.
- Classroom Pack (35 students): A pack of 35 licences for a class group.
- Campus 1000: Unlimited licence for centres with up to 1,000 students.
Packs can be combined with each other and with individual licences. Specific pricing and billing conditions are detailed on the pricing page.
4.4. Trial period (B2B Demo)
Educational centres may request a free trial period of 30 calendar days. The trial includes:
- Up to 25 students
- Access up to level 10 of the curriculum
- Full administration panel
- No AI content generation (this feature requires a paid plan)
At the end of the trial period, access is automatically limited to the free plan for all users of the centre if no paid plan is contracted. Trial period data (student progress, statistics) is retained.
4.5. Seat-based licensing and reassignment period
The Educational Centre Plan operates on a seat-based licensing model. Each licence allows one student to access the platform.
4.5.1. Licence assignment
Once payment is made, the licences purchased are added to the organisation's available pool. The centre administrator decides which students the licences are assigned to, by:
- Creating student accounts directly
- Sharing the centre's access code
- Importing via CSV, from Google Workspace/Classroom or from Microsoft 365
Each student joining the organisation consumes one licence from the pool. When all licences are in use, no new students can be added until existing licences are released or additional licences are purchased.
4.5.2. Reassignment period (90-day cooldown)
To ensure fair use of the service and prevent abusive licence rotation, a reassignment period of 90 calendar days applies (hereinafter, the "cooldown period").
When an administrator withdraws a student's licence (whether because the student leaves, changes class, is expelled or for any other reason):
- The student immediately loses access to centre features. They may continue using Kluppy in free mode with their personal account.
- The licence is locked for 90 calendar days from the date of release. During this period, the licence is not available for reassignment to another student.
- After 90 days, the licence automatically returns to the organisation's available pool and may be assigned to a new student.
4.5.3. Exceptions to the cooldown period
- Expiry of the annual licence: At the end of the centre's annual subscription period, all licences (including those in a cooldown period) are automatically released. The cooldown does not survive the end of the subscription.
- Exceptional resolution: In extraordinary circumstances (administrative error, duplicate student, etc.), Kluppy may, at the centre's justified request, release a licence from the cooldown period early. This exception is at Kluppy's sole discretion.
4.5.4. Effects on student data
When a student's licence is withdrawn:
- The student retains their personal data (progress, statistics, achievements) in their account.
- The student may continue accessing Kluppy in free mode.
- The student's data is unlinked from the centre's management panel.
- The student may export their data at any time under Article 20 GDPR (right to data portability).
5. Registration and User Account
5.1. Requirements
- You must provide truthful and up-to-date information.
- You must be at least 14 years old or have authorisation from your parent or legal guardian (Art. 7 LOPDGDD).
- You may only have one account per person.
5.2. Account Security
- You are responsible for maintaining the confidentiality of your password.
- You must notify us immediately of any unauthorised use of your account.
- Sharing login credentials is not permitted. Each account is strictly personal and non-transferable. Sharing, assigning, or selling your account may result in an immediate and permanent ban.
5.3. Educational Centre Accounts
When an educational centre registers:
- The centre's representative confirms they have authority to contract on behalf of the institution.
- The centre undertakes to obtain the necessary parental consent for minors' use of the platform.
- The centre is responsible for the users it invites to the platform.
6. Acceptable Use
6.1. You agree to:
- Use Kluppy lawfully and in accordance with these Terms.
- Not attempt to access other users' accounts or data.
- Not use the platform for purposes other than typing learning.
- Not attempt to breach the platform's security.
- Not use bots, scripts or automated tools to simulate activity.
- Respect other users in social features (leagues, rankings, chat).
6.2. The following is prohibited:
- Sharing offensive, illegal or inappropriate content through the support system.
- Fraudulently manipulating rankings or statistics.
- Reselling or redistributing access to the platform.
- Mass extraction or copying of platform content (scraping).
6.3. Consequences of Non-compliance
We reserve the right to permanently ban or cancel your account without prior notice and without any refund right if you breach these Terms (especially regarding the use of bots, ranking manipulation, or account sharing), without prejudice to any legal action that may apply.
6.4. User-Generated Content (UGC) Moderation
We reserve the right to immediately review, hide or remove any username, profile picture, message (in tickets or chats) or interactive content that is deemed offensive, harassing, fraudulent, hateful or contrary to the law, without the need for prior notification or structured justification to the offender.
7. Intellectual Property
7.1. Kluppy Content
All elements of the platform (design, code, exercise texts, graphics, logos, icons, structure) are the property of Kluppy or its licensors and are protected by intellectual and industrial property legislation.
All rights reserved. The reproduction, distribution, public communication or transformation of any platform content without the express written authorisation of the owner is expressly prohibited.
7.2. AI-Generated Texts
Exercise texts generated by Artificial Intelligence (Vertex AI) are created specifically for typing practice. Their use is limited to the educational context within the platform.
Fair Use Policy: Kluppy reserves the right to limit or temporarily suspend a user's ability to algorithmically generate texts via Artificial Intelligence if a disproportionate, massive, or abusive use is detected that poses a serious structural risk to server stability or generates exponentially anomalous costs for the service.
7.3. Limitation of metric use and AI Act (Regulation EU 2024/1689)
Kluppy provides performance statistics (words per minute, accuracy, XP, levels, achievements) as informational tools to track typing progress and for educational gamification purposes. These metrics:
- Must not be used as official academic grades, formal exam scores, or as the sole basis for academic evaluations or decisions that significantly affect the student.
- Are not a substitute for assessments conducted by qualified educators.
In compliance with the Artificial Intelligence Act (AI Act), the use of Kluppy is classified as a "limited risk" system as it is merely auxiliary. The use of platform metrics for official evaluation purposes is expressly prohibited, as it would constitute a breach of these terms and would shift the responsibility for regulatory compliance as a "high risk" system (Annex III of the AI Act) to the infringing educational centre.
7.4. User Content
The data you generate (statistics, progress, achievements) belongs to you and you can download it at any time from your profile ("Download my data" button).
8. Payments and Billing
8.1. Payment Processing
Payments are processed through Stripe, a PCI-DSS Level 1 certified payment gateway. Kluppy never stores your credit/debit card details.
8.2. Pricing
Prices are displayed in euros (EUR) and include VAT where applicable. We reserve the right to modify prices with 60 days' prior notice.
8.3. Billing
Invoices are issued automatically and are available in your user dashboard and by email in PDF format. To request invoices with additional tax details (Tax ID, address), please contact us.
8.4. Refunds
- Trial period: The free trial generates no charges.
- Monthly subscriptions: You may cancel at any time. Access is maintained until the end of the billed period. No partial refunds are made.
- Annual subscriptions: You may request a proportional refund within the first 14 days of contracting.
8.5. Right of withdrawal
In accordance with Spanish Royal Legislative Decree 1/2007 and Directive 2011/83/EU, you have the right to withdraw from the contract within 14 calendar days from the date of contracting the service, without giving any reason.
How to exercise it:
- Go to the withdrawal page at https://play.kluppy.com/legal/desistimiento
- Log in with your account
- Select the contract you wish to withdraw from
- The system will automatically process the cancellation and the applicable refund
Deadline: 14 calendar days from the initial contract date. For auto-renewing subscriptions, the deadline applies only to the initial contract, not to each renewal.
Refund: The refund will be issued within a maximum of 14 days from the request, using the same payment method used in the original transaction. The refund is issued in full unless, when contracting, you expressly requested the immediate start of the service, in which case the proportional part of the service already provided up to your notice is deducted (Art. 108.3 RLD 1/2007; see the B2C Subscription Terms, section 7.2).
Exception (Art. 103.a RLD 1/2007): If the service has been fully provided with your prior express consent and with your acknowledgement that you will lose the right of withdrawal once the service is complete, the right of withdrawal shall not apply.
Model withdrawal form (Annex B RLD 1/2007):
To Kluppy S.L., Mikeletegi pasealekua 65 (Planta Baja, Local 1), 20009, Donostia - San Sebastian, Gipuzkoa (info@kluppy.com): I hereby give notice that I withdraw from my contract for the provision of the following service: [service description] Contracted on: [date] Name of consumer: [name] Address of consumer: Mikeletegi pasealekua 65 (Planta Baja, Local 1), 20009, Donostia - San Sebastián, Gipuzkoa Signature (only if on paper): Date:
8.6. Non-payment
In the event of non-payment, we reserve the right to limit access to paid features until payment is regularised.
8.7. B2B licences: billing and reassignment
Educational Centre Plan licences are billed annually. The centre may purchase additional licences at any time during the subscription period; these are billed on a pro-rata basis up to the renewal date.
Licence reassignment is subject to the 90-day cooldown period described in Section 4.5.2. The centre can check the status of its licences (in use, available and in cooldown) from the administration panel, in the "Billing" section.
8.8. Renewal, upgrade and downgrade of B2B licences
8.8.1. Annual renewal
B2B licences are valid for 12 months from the date of purchase. Renewal is not automatic: the centre must make a new purchase before the expiry date.
Kluppy sends renewal reminders to the centre administrator at the following intervals:
- 90 days before expiry (advance planning notice)
- 30 days before (reminder with access to the billing panel)
- 15 days before (notice including the centre's usage statistics)
- 5 days before (final urgent notice)
Each reminder includes a direct link to the billing panel where the renewal can be completed.
8.8.2. Upgrade
The centre may purchase additional licences at any time during the active subscription period. New licences are added to the existing pool and share the same expiry date.
8.8.3. Downgrade
It is not possible to reduce the number of contracted licences during the active period, nor to request a partial refund. If the centre needs fewer licences for the next school year, it simply needs to purchase a smaller pack at renewal.
8.8.4. Expiry without renewal
If the centre does not renew before the expiry date:
- All licences are deactivated (students lose access to centre features).
- Pending cooldowns (Section 4.5.2) are automatically cancelled.
- Data is retained: student progress, statistics and centre configuration remain intact.
- If the centre renews later, the data is automatically restored when the licences are reactivated.
